1 About our Terms of Use (the “Terms”)
1.1 These Terms explain how You may use www.pzaz.online (the “Site”). It is recommended You print a copy of the Terms and Conditions for future reference.
1.2 Reference in these Terms to the Site is intended to refer to www.pzaz.online and all associated web pages.
1.3 You should read these Terms carefully before using the Site and check regularly for any revisions to the Terms and Conditions. It is indicated at the top of this page when the Terms and Conditions were last revised.
1.4 By accessing or using the Site or otherwise indicating Your consent, You agree to comply with and be bound by these Terms and the documents referred to in them, including after any revisions have been made.
1.5 If You do not agree with or accept any of these Terms, You should stop using the Site immediately.
2 Who we are and how to contact us
2.1 Our Site is operated by The Primary Science Advisory Service Limited (“We”, “Us” or “Our” or referred to as PZAZ). We are registered in England and Wales under company number 12585985 and have Our registered office at 12 Ridgetor Road, Woolton, Liverpool, L25 6DQ . 2.2 The terms “You”, “Yourself” and “Your” refers to the user or viewer of the website.

2.4 PZAZ is the Data Controller within the definition of the General Data Protection Regulation (GDPR).
3 Definitions
3.1 Content means any document, text, images, video, audio or other multimedia content, software, application (‘app’) or other information or material submitted to or on the Site, which includes but is not limited to the Online Portal Content;
3.2 Online Portal has the meaning given to it in clause 6.1;
3.3 Online Portal Content has the meaning given to it in clause 6.3;
3.4 Privacy and Cookie Policy means the policy, which governs how We process any personal data collected from you;
3.5 Safety Information has the meaning given to it in clause 7.1;
3.6 Site has the meaning given to it in clause 1.1;
3.7 Terms means these terms and conditions of use as updated from time to time under clause 12;
3.8 User Content has the meaning given to it in clause 9.1;
3.9 We, Us or Our has the meaning given to it in clause 2.1; and
3.10 You, Yourself or Your is defined in Clause 2.2.
3.11 School means any educational establishment, individual, company or commercial enterprise approved for subscription or temporary access by PZAZ.
4 Other Terms
Your use of the Site means that You must also comply with Our Privacy and Cookie Policy, where applicable.
5 Using the Site
5.1 The Site is for non-commercial use only, although You may be able to use the Online Portal in the course of Your work if You comply with clause 6.1.
5.2 You agree that You are solely responsible for all costs and expenses You may incur in relation to Your use of the Site.
5.3 Should you be an educational establishment outside the UK, it is encumbent on You to be compliant with local laws.
5.4 We seek to make the Site as accessible as possible. If You have any difficulties using the Site, please contact Us on the contact details provided at clause 2.3.
5.5 We may prevent or suspend Your access to the Site if You do not comply with any part of these Terms, any terms or policies to which they refer or any applicable law.
5.6 This Site is meant for school use only unless authorised by PZAZ. We reserve the right to suspend or prevent Your access to the Site if you are not a school or individual, body or enterprise authorised by PZAZ.
5.7 Only representatives of an individual school may use the site. If you are an individual who wishes to access any materials on the portal, or an individual representing a company or other commercial enterprise, you must first obtain permission from PZAZ. You can contact PZAZ using the information contained in 2.3.
6 Using the Online Portal
6.1 There is a section of the Site that may only be accessed and used by certain users of the Site. This is our “Online Portal” and You must only access and use it if:
6.1.1 You are employed or engaged by a school that is a subscriber to the PZAZ product; If you are not a school, you will need permission to subscribe to PZAZ. This permission can be sought by contacting [email protected]
6.1.2 We have provided You with a password for the purposes of logging in to the Online Portal.
6.1.3 If You have been provided by PZAZ with a password for the purposes of logging in to the Online Portal, PZAZ reserves the right to limit the time of access, and can suspend or deny access to the resources on the Online Portal without warning or notice.
6.2 You are solely responsible for keeping any password, user identification code or other log in details confidential solely to employees of your school . You, Your employees or individuals contracted to your organisation may not share them with any other school (including those in your cluster, academy trust or local authority), or individual, company or other enterprise. If You know or suspect that anyone other than those described above has shared your log in details with body or individual outside of your school, You must promptly notify Us.
6.3 You may not share or broadcast any document, text, images, video, audio or other multimedia content, software, application (‘app’) or other information or material submitted to or on the Site, with any 3rd party without prior approval from PZAZ (including those in your cluster, academy trust or local authority), or with any individual, company or other enterprise. If You become aware that this has occurred, You must promptly notify Us.
6.4 The Online Portal gives You access to teaching content including lesson plans, PowerPoints, videos and other relevant teaching materials, and Safety Information (the “Online Portal Content”).
6.5 Subscribers to the online portal do not own any of the material that is used. Should Your subscription end (this includes any free period or other such offer where Your school has access to the online portal), Your school will no longer be free to use PZAZ's materials that have been stored in any manner whatsoever including printed and electronically. You agree to delete all PZAZ material stored in whatever manner including school and personal electronic devices, 'Cloud' based storage and in printed form. All material owned by PZAZ shall be deleted or destroyed and not used by any employee of Your school. Furthermore, no individual will remove any such material belonging to PZAZ for personal use or pass the material onto a third party.
6.6 PZAZ reserves the right to suspend or terminate Your access to the Online Portal Content at any time. There may a cost no greater than the cost of your annual subscription for such an action.
6.7 Users of the Online Portal Content are required to operate on a 'Fair Policy' basis. This includes excessive downloading or printing of PZAZ's materials.
6.8 Payment for PZAZ will be due after Your free period of access is completed. Should You continue to use the contents of the online portal after this time, PZAZ will view this as Your agreement to subscribe for at least one year from the end of the free period of access. Any waiver of subscription at this time will be at the sole discretion of PZAZ.
Health and Safety Information
7.1 Safety Information provided to subscribers of PZAZ and available on The Site includes risk assessments, safety data sheets and health and safety guidance and the verbal health and safety guidance in PZAZ CPD videos. It has been prepared by Us using reasonable care and skill based on the information known to Us at the time. We will not have liability for any activities not carried out in accordance with the Safety Information or if you are using or accessing the Safety Information in breach of clause 6.1, above. The Safety Information must also be used in conjunction with Your school’s own health and safety policies.
7.2 All activities described in the Safety Information must only be carried out on school premises, in accordance with Our applicable lesson plans, and by personnel in your school. You must also check that this is the most up to date Safety Information provided by Us by checking the Online Portal and be sure that Your school has confirmed that it is up to date and accurate. By proceeding with any of the activities described in the Safety Information You confirm that You have read the parts applicable to such activities in full and will comply with its contents.
7.3 Where any activities take place off school premises, Your school accepts full liability for the Health and Safety of all individuals under the care of the school at that time. PZAZ accepts no liability for off school premises activities.
8 Ownership, use and intellectual property rights
8.1 This Site and all intellectual property rights in it including but not limited to any Content are owned by PZAZ. Intellectual property rights means rights such as: copyright, trademarks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind whether or not they are registered or unregistered (anywhere in the world). We reserve all of Our rights in any intellectual property in connection with these Terms. This means, for example, that We remain owners of them and free to use them as We see fit.
8.2 Nothing in these Terms grants You any legal rights to the Site other than as necessary to enable You to access the Site. You agree not to adjust, to try to circumvent or delete any notices contained on the Site (including any intellectual property notices) and in particular in any digital rights or other security technology embedded or contained within the Site.
8.3 You may only make a copy of any part of Our Site or the Content as is reasonably necessary for Your own personal use or as You otherwise agree with Us in writing.
8.4. You must not modify any Content You copy from Our Site in any way. Our status as the authors of Content on Our Site must always be acknowledged. If You print off, copy or download any part of Our Site, including any Content, in breach of these Terms, Your right to use Our Site will cease immediately and You must return or destroy any copies of the materials You have made.
8.4 You must not use any of the Content in any manner to assist or take part in the development, marketing, or sale of a product or service which is competitive or potentially competitive with the PZAZ product or otherwise creates a product or service which is (in whole or in part) the same as or similar.
8.5 Provided Your access to the Online Portal is not in breach of clause 6.1, You may save, print and copy the Online Portal Content to the extent reasonably necessary for Your use of the PZAZ product, but You may not distribute the Online Portal Content to third parties, whether on its own or combined with any other data or information (including Your own data or information), unless We otherwise give you Our written consent or as part of your own statutory duties or legal compulsion. This means work using or derived from any Online Portal Content which have been fairly and reasonably created by You in the ordinary course of the Your activities for the purpose of recording, marking, assessing, documenting, reporting or evidencing pupil attainment and/or progression for any and all formal, informal, statutory or similar purposes and not for any other purpose.
9 Submitting information to the Site
9.1 We may from time to time enable features that allow you to upload any photograph, video, comments, messages or other content (the “User Content”). If you use any such feature you must comply with the provisions of section 8.
9.2 By uploading any User Content you acknowledge and agree that you are the author and owner of that User Content and all rights in it and that it complies with all applicable laws and is not obscene, defamatory or likely to be offensive to any other person and will not cause any damage to our reputation.
9.3 You also agree that we have the right to delete any of the User Content that you may upload from time to time and to edit it and use it as we see fit on our Site and in connection with any of our products or services as may exist from time to time, and in connection with any promotion, publicity or marketing of our Site, products or services as may exist from time to time.
9.4 We have the right to disclose Your identity to any third party who is claiming that any User Content posted or uploaded by You to Our Site constitutes a violation of their intellectual property rights, or their right to privacy. We have the right to remove any User Content You post on Our Site.
9.5 You must not misuse Our Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to Our Site, the server on which Our Site is stored or any server, computer or database connected to Our Site. You must not attack Our Site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, You would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and We will co-operate with those authorities by disclosing Your identity to them. In the event of such a breach, Your right to use Our Site will cease immediately.
10 Accuracy of information and availability of the Site
10.1 While We try to make sure that the Site is accurate, up-to-date and free from bugs and viruses, We make no representations, warranties or guarantees, whether express or implied, that the Content on Our Site is accurate, complete or up to date. You should use Your own virus protection software. Furthermore, We cannot promise that the Site will be fit or suitable for any purpose.
10.2 Any reliance that You may place on the information on this Site is at Your own risk. Content is provided for Your general information purposes only. It does not constitute technical, financial or legal advice or any other type of advice and should not be relied on for any purposes. We draw your attention to sections 6 and 7 in relation to any use You may make of any Online Portal Content and particularly any Safety Information.
10.3 While We try to make sure that the Site is available for Your use, We do not promise that the Site is available at all times nor do We promise the uninterrupted use by You of the Site. We may suspend or terminate operation of the Site at any time as We see fit.
11 Links and third party sites
11.1 The Site may contain links or references to third party websites. Any such links or references are provided for Your convenience only. We have no control over third party websites and accept no legal responsibility for any content, material or information contained in them. We offer no assurances of any product you purchase from these sites. The display of any hyperlink and reference to any third-party website does not mean that We endorse that third party’s website, products or services. Your use of a third party website may be governed by the terms and conditions of that third party website.
11.2 You may link to Our home page, provided You do so in a way that is fair and legal and does not damage Our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on Our part where none exists. You must not establish a link to Our Site in any website that is not owned by You. We reserve the right to withdraw linking permission without notice. If You wish to link to or make any use of Content on Our Site other than that set out above, please contact Us.
12 Our responsibility for loss or damage suffered by You
12.1 We do not exclude or limit in any way Our liability to You where it would be unlawful to do so. This includes liability for death or personal injury caused by Our negligence or the negligence of Our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
12.2 To the maximum extent permitted by law We exclude all implied conditions, warranties, representations or other terms that may apply to Our Site or any Content on it.
12.3 We will not be liable to You for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with use of, or inability to use, Our Site; or use of or reliance on any Content displayed on Our Site.
12.4 In particular, We will not be liable for:
12.4.1 loss of profits, sales, business, revenue, anticipated savings, business opportunity, goodwill or reputation or any business interruption; or
12.4.2 any indirect or consequential loss or damage.
13 Rights of third parties
No one other than a party to these Terms has any right to enforce any of these Terms.
14 Variation
No changes to these Terms are valid or have any effect unless agreed by Us in writing. We reserve the right to vary these Terms from time to time. Our updated terms will be displayed on the Site and by continuing to use and access the Site following such changes, You agree to be bound by any variation made by Us. It is Your responsibility to check these Terms from time to time to verify such variations.
15 Disputes
These Terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by the laws of England and Wales. Parties to these Terms agree to the exclusive jurisdiction of the courts of England and Wales.

This policy (together with our Website Terms of Use) sets out the basis on which any personal data we collect from you, that you provide to us, or which we hold about you, will be processed by us. Information that you provide to through our website www.pzaz.online (the “Site”). This includes information provided to us via any contact or enquiry form on the Site or if you contact us in connection with any of our services, including the “PZAZ” product. We may also ask you for information when you report a problem with the Site.
User content including photographs, videos and other content that you choose to share on the Site and any associated content including comments that you post to the Site.
If you contact us, we may keep a record of that correspondence.
Details of your visits to the Site, the resources that you access, and how you access them. This may include information about the device you are using, how your device interacts with the Site (for example crashes and system activity), your search queries and information about your actual location at the time of using the Site.
Information about your computer, including (where available) your IP address, operating system and browser type. This is statistical data about our users’ browsing actions and patterns.
If you use any third party services that are interoperable with the Site, or where you follow a link from the Site to such third party service providers, we may receive information from the third parties about your use of those services.

In addition, if you login and use our Online Portal (please see clause 6 of our Website Terms of Use for more information about this), we will process your name, contact details, and email address, as well as your login details, such as username and password.
